This Agreement is made as of 23-08-2024 23th August 2024.
1. Agreement
This agreement ("Agreement") is entered into between Velvox Gamehosting ("Gamehosting Provider") and the customer ("User"). By using the game hosting services, the User agrees to these Terms and Conditions. The User also accepts the Data Processing Agreements (DPA's) with the partners of Gamehosting Provider when this Agreement is accepted by ticking the box by the account creation and in the ordering process. The DPA's do also need to be accepted by the User apart from this Agreement when the acount is created.
2. Services
The Gamehosting Provider grants the User access to game hosting services according to the chosen subscription level. The Gamehosting Provider reserves the right to modify, suspend, or terminate the services at any time.
3. Payment and Billing
(a) The User agrees to pay the established fees according to the chosen subscription level. Billing occurs on the same day as the order is placed (unless otherwise indicated). In case of non-payment, the Gamehosting Provider reserves the right to suspend or terminate the services.
(b) Users acknowledge that automatic debits via credit card, SEPA and PayPal are used for subscription payments.
(c) In the event of subscription cancellation, the User must notify this 7 calendar days before the next debit.
(d) Refunds do not apply to automatic debits if the User fails to cancel the subscription in a timely manner.
4. Use and Behavior
(a) The User agrees not to use the game hosting services for unlawful or harmful activities. Such inappropriate behavior may result in immediate suspension of services.
(b) The Gamehosting Provider is not responsible for the User's unlawful or harmful activities and does not monitor them.
5. Liability
(a) The Gamehosting Provider is not liable for data loss, service interruptions, or any direct and/or indirect damages. The liability of the Gamehosting Provider is limited to the amount paid for services during the last billing period.
(b) The Gamehosting Provider does not provide compensation in case of data loss.
6. Termination
This Agreement may be terminated by both parties with a notice period of 7 days before the end of the billing period. In case of a breach of these Terms and Conditions, the Gamehosting Provider has the right to terminate services immediately.
7. Refunds
(a) Refunds are subject to the Gamehosting Provider's applicable refund policy, available on our website.
(b) Users acknowledge that services are offered on a subscription basis and fees are prepaid.
(c) Refunds may be denied in case of violation of the Terms and Conditions or inappropriate use of services.
(d) The maximum refund period is 48 hours, counted from the moment the order is processed and activated. To request a refund, a ticket must be opened through the customer panel.
8. Affiliates & Partners
(a) Partnership requests are handled through a ticket on the customer panel. If this is not done, the Gamehosting Provider does not recognize it as a legitimate partnership.
(b) If a partner wishes to terminate the partnership, it must be discussed with the Gamehosting Provider. If this is not done, the partner is not authorized to terminate the partnership.
(c) Affiliates can only be paid when reaching €25 in "Commission." No exceptions will be made.
(d) Affiliate commission is awarded 48 hours after receiving payment from the newly referred user. This is to ensure that if the newly referred user terminates or refunds their package, undue commission is not awarded.
(e) Affiliates can opt-out of the affiliate program at any time but will only be paid when the minimum of €25 is reached.
(f) Affiliates receive a standard 5% per transaction. This may vary per package and does not need to be specified in advance.
9. Changes
The Gamehosting Provider reserves the right to change these Terms and Conditions at any time. The User will be notified of such changes.
By using the game hosting services, the User agrees to these Terms and Conditions.
